Safaricom’s out-of-court bid in data leak case fails badly

Safaricom’s plan to settle a big case outside court over a data leak has failed. The High Court will now hear the case, which involves the private information of more than 11.5 million customers.

According to a post by MoneyAcademyKe on X on Monday, “Safaricom’s attempt to settle a case outside court over leaked data of 11.5 million customers has failed.

The High Court will now hear the case after talks collapsed. The data, including names, IDs, and betting records, was allegedly shared with a sports betting firm.”

This latest scandal has added to growing anger among Kenyans who feel that Safaricom has become careless with their personal data.

Many people believe that the company, under CEO Peter Ndegwa, is more focused on profits than on protecting users. Others complain about the high cost of calls, data, and M-Pesa charges, even as service quality continues to drop.

Kenyans have also raised fears about Safaricom’s close links with government security agencies. During protests against the Finance Bills of 2024 and 2025, and especially on June 25, 2024, when the Gen Z protests were hijacked by goons, there was a nationwide network blackout.

Soon after, reports emerged of police using phone records to track and abduct protesters and activists. Human rights groups blamed Safaricom for providing Call Data Records to rogue officers.

Safaricom has denied those claims, saying it always follows the law. But many Kenyans remain doubtful.

They say a company that holds the personal data of millions of people should act with more honesty and transparency.

As the court prepares to hear the data leak case, Safaricom faces a big test.

Will it protect the privacy of its customers or continue to be seen as a company that puts money and power before the people who made it great?
