The Cooperative Tribunal has finally ordered PCEA elder David Nderitu Ndumo to pay a Sh 8 million he borrowed from Sheria SACCO some Five years ago subjecting 15 guarantors to untold suffering after their pay have been deducted to service the loan.
It has been a long wait for the guarantors represented by lawyer Wambugu Wanjohi after the elder who was recently installed at the PCEA Treasurer in blatant defiance of a High Court Order stopping his assuming of office.
Those responsible for the flagrant disobedience of the Law to install Mr Ndumo have their day in court on March 13, 2025 for cross examination.
PCEA Secretary General Rev. Robert Waihenya and the Moderator Rev Thegu Mutahi will appear before the high court this Thursday in person for cross examination on why they should not nb committed to civil jail after defying its legal orders.
His installation was seen by many faithful as impunity and adding salt to injury of his friends who he betrayed by declining to pay despite the ability to do so.
During a session yesterday, it was established that Mr. Ndumo had paid Sh 1.8 million out of the Sh 8 million and has committed to pay a monthly installment of Sh 132,000 for the next 48 months which is four years.
The tribunal issued a stern warning that should he default in his monthly obligations then the guarantors will be at liberty to force compliance.
Previously the tribunal had allowed the auctioning of his property including three vehicles and other personal effects to recover the monies owed.
“So a mention will be taken where a Consent will be adopted to the effect that if he defaults on any of the 48 monthly instalments of Sh 132,000 the Guarantors will proceed to execute,” explained counsel Wambugu who is representing the guarantors.
Mr Ndumo will also pay the costs as well as auctioneers fees.
Rev Waihenya and Rev Mutahi case was moved from last month after one of them requested to be given time to travel to the US for personal commitments.
The duo had explained in court that they head nit ben duly served by the injunction but from further probe they explained in an affidavit that due to the presence pf some top political dignitaries, they could not stop the installation.
But in a video submitted by the lawyer of one of the faithful, it is seen how the Rev Timothy Njoya walks out in protest during the 25th General Assembly upon Re Mutahi refusing to be served by the court order, at the St Andrews cathedral in Nairobi last April.
