Constable Mukhwana’s lawyers cry foul over threats after exposing top police bosses

The legal team representing Police Constable James Mukhwana has come out strongly to raise alarm over alleged intimidation and surveillance. They claim they are being followed by unknown individuals believed to be plainclothes police officers.

These claims come shortly after their client, Constable Mukhwana, gave a serious statement linking senior police officials to the murder of blogger and teacher Albert Omondi Ojwang’. The lawyers Kevin Ondago, Clinton Mwale, and Bietta Wavinya spoke to Citizen Digital and described a series of strange and worrying encounters. They revealed that they had officially filed a complaint at Capitol Hill Police Station after noticing suspicious behavior around them.

One of the lawyers, Kevin Ondago, said they keep seeing the same car trailing them after leaving their offices or court sessions. He said this is a clear tactic to scare them and stop their client from speaking the truth.

These claims are being made not long after Constable Mukhwana gave an eye-opening testimony before the Independent Policing Oversight Authority. In his statement, Mukhwana said that he was instructed by Central Police OCS Samson Talaam to take part in what was referred to as disciplining Ojwang’. The statement went further to point fingers at the Deputy Inspector General of Police, Eliud Lagat, saying the order came from top leadership in the police force.

Mukhwana detailed how Ojwang’ was taken to Central Police Station on the night of June 7, 2025, in a black Subaru and booked in at around 9:20 p.m.

That same night, four inmates Collins Ireri, Gil Ammiton, Brian Mwaniki, and Erick Ndambuki were reportedly directed to beat Ojwang’. The beating turned deadly, leading to Ojwang’s death from serious injuries. These four inmates have now been arrested and taken to court.

Constable Mukhwana confessed that he stayed quiet at first because he was afraid of backlash from other officers. He feared becoming a scapegoat. But as time went by, guilt took over, and he chose to return to IPOA and tell the truth about what happened.

Since then, he has refused to seek bail and has instead asked to be placed under witness protection, saying his life is in danger. His lawyers have said they are ready to pursue justice for Ojwang’ and to support Mukhwana, but they are demanding an end to the threats and harassment they are facing.

Lawyer Clinton Mwale said clearly that they are only doing their job, and the attempts to intimidate them should stop immediately.
